Terms of Service

These terms govern your use of the website design and management services provided by UnderCurrent Automations ABN (pending) ("UnderCurrent", "we", "us"). By placing an order or using our services, you agree to these terms.
1. Service Description
UnderCurrent designs and builds custom websites for Australian trades businesses. Our standard service includes:
- A custom-built, mobile-responsive website
- Professional copywriting tailored to your trade and service area
- SEO setup for local search visibility
- Contact forms, Google Maps integration, and essential business pages
- Domain setup and configuration
2. Pricing and Payment
The website build fee is $449 AUD (inclusive of GST, if applicable). Payment is split as follows:
- $112 deposit payable upfront when you confirm your order
- $337 balance payable on delivery, before your site goes live
All payments are processed through Stripe. We do not store your card details.
3. Delivery Timeline
We aim to deliver your completed website within 7 business days of receiving your deposit and completed onboarding information. This timeline is a target, not a guarantee. Delays may occur due to incomplete information, revision requests, or circumstances outside our control.
We will keep you informed of progress throughout the build process via email.
4. Review and Revisions
Before your website goes live, you will receive a preview link to review the site. You can request reasonable revisions to content, images, and layout. We want you to be happy with your site before it launches.
Major scope changes (additional pages, features not included in the original brief) may incur additional charges, which we will discuss with you before proceeding.
5. Domain and Hosting
We manage domain registration and hosting on your behalf as part of our service. Your domain is registered in your name where possible. If you cancel your subscription, we will assist with transferring your domain to you or another provider upon request.
Hosting is included as part of the monthly subscription. Without an active subscription, your site will be taken offline.
6. Content Ownership
Your content: You retain full ownership of any content you provide, including your business name, logo, photos, and other materials.
Our work: The website design, code, templates, and underlying technology remain the intellectual property of UnderCurrent. We grant you a licence to use the website for as long as your subscription is active.
Generated copy: Website copy written for your business becomes yours to use freely, even if you cancel your subscription.
7. Subscription Terms
After your website launches, an ongoing subscription of $50 AUD per month covers hosting, maintenance, security updates, and basic content changes.
- Billing is monthly via Stripe
- You can cancel at any time with no exit fees or lock-in contracts
- Upon cancellation, your site will remain live until the end of your current billing period
- After cancellation, your site will be taken offline. We will retain your data for 90 days in case you wish to reactivate
8. Cancellation and Refunds
Before delivery: If you cancel before we deliver your website, we will refund your deposit minus any costs already incurred for work completed.
After delivery: Once your website has been delivered and the balance paid, the build fee is non-refundable. This reflects the custom nature of the work.
Subscription: Monthly subscription payments are non-refundable for the current billing period. You can cancel at any time to prevent future charges.
9. Your Responsibilities
To help us deliver your website on time, you agree to:
- Provide accurate and complete information during onboarding
- Respond to review requests and communications in a timely manner
- Ensure any content you provide (photos, logos, text) does not infringe on any third-party rights
- Not use your website for any unlawful purpose
10. Limitation of Liability
To the maximum extent permitted by Australian law, UnderCurrent's total liability for any claim arising from or related to our services is limited to the amount you have paid us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, or consequential damages, including lost profits, lost business, or loss of data, except where such exclusion is prohibited by law.
We do not guarantee any specific business outcomes (such as increased calls or revenue) from having a website. Results depend on many factors outside our control.
11. Service Availability
We aim for high availability but do not guarantee uninterrupted access to your website. Downtime may occur for maintenance, updates, or due to third-party service outages. We will make reasonable efforts to minimise disruption and notify you of planned maintenance.
12. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria. Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law.
